Well I would not say it hurts the overall litigation.
It will hurt SK damages argument if they do win though. But it is always hard to prove speculative damages. SK can/could still recover damages based on how much they paid EPIC and how much they lost in renegotiated contracts.
We can't say how many copies TH would have sold if it came out under the UE at the time is was suppose to. Maybe it would have sold an extra 2 million copies maybe not. They can still win the fundamental contract issue but they may not get as much or any damages![]()
this could of been solved easy, if they would of cooperated and made gears as good as they did and made Too Human what it was said it was suppose to be, too human was a very rushed game, the stick combat was not a problem it was just quite a few other things.

If they had launched in the Fall of '07 they would have faced off against Halo 3, Mass Effect, and Assassin's Creed, and that's just on the 360. Multiplatform launches were strong as well.
I am not worried about them breaking even if they win the contract issue. Most times the winner will be awarded litigation costs. So if SK wins EPIC will at least have to pay them the legal fees. I imagine they will also get back whatever licensing fees they paid to EPIC.
More than that is hard to judge. They should be asking for the difference in profits that they would have received under the original contract from MS so if they were initially entitled to say 10% of games sales and had to renegotiate for 5% they should be able to recover the extra 5% based on actual TH sales.
Llyods analyse included lost revenue from lost opportunities or games not made which are pretty hard to prove.
Too Human was definitely a rushed game. I don't think I've ever played another game as broken as it is. I have also only played a few that were as fun as it was. I agree with Ouas, if Silicon Knights had waited and fixed a lot of the crap that is wrong with the game it would have been outstanding. Probably even one of the best games this generation.
Well, let us hope SK wins the case... and soon. How much longer can they take this?

The only thing I thought was broken about the game was the lack of a bank. Other than that most everything was amazing. I really didn't have much of a problem with the camera, do you really want full control over it as a zerker???

true, but they patched all the problems and fallout or oblivion is about 5 times bigger then too human, don't get me wrong I have not played any 360 game more then this, but it had a lot of problems that turned people off, the stick combat I loved it, I loved grinding, I loved coop, but cheap deaths, everlasting negative status effects, posion/ice snipers and the dlc menu in the armor and weapon shop kinda ruined the game a bit

Okay, Fallout 3 and Fallout 3.1 were both pretty damn broken but Too Human was too. Am I the only one who remembers the complex math involved in figuring out what stuff does versus what stuff says it does?
My favorite pass time in Hel was knocking people through the floor of the elevator.
Everything about the game after the first level was rushed imo.
The first level felt very different than the other levels. I'm hoping for more of that in the future.
The other thing that I would love them to work on is the story. For a lot of people the story was confusing and a little boring at times, they need to rewrite it so that it doesn't play out like the way it did in the first game and more like current games.
After playing(I should say still playing) so much Batman AC, all I could think of is of a TH sequel being like that. I don't want TH to be like Batman but what I'm trying to say is that I would like it to have all the good qualities that make Batman AC so great.

Yes TH was suppose to be an early launch title. They whole UE thing slowed it down it should have released at least a year earlier than it did. The release date was pushed back a lot.
I'm sure EPIC has money and backing - enough to make it a challenge for SK. But this is a David and Goliath story and I hope it pans out the way the original did.

Even though we will never know all the details regarding this lawsuit I want to be in the party when Denis lets us all know his true feelings regarding EPIC. That would be so much fun. :-)
